MiSpeL is the word everyone in the German storage industry is using and almost nobody explains. Yet this determination decides whether a battery storage system can be operated profitably in Germany at all. Since 5 August the regulator's working draft is public, and the timeline is set.
What MiSpeL actually is
MiSpeL stands for Marktintegration von Speichern und Ladepunkten, the market integration of storage systems and charging points. It is not a law but a determination by the Federal Network Agency, meaning a binding regulatory decision. The proceeding runs under file number 618-25-02 and was opened on 31 July 2025. Anyone planning, building or financing a battery storage project in Germany has to deal with these rules.
The term is everywhere right now because it settles a question that has held back German storage projects for years: what happens when a battery takes in not only subsidised solar power from its own roof, but also electricity from the grid?
The all-or-nothing problem
Until now the rule was essentially this: a storage system that charged grid power alongside subsidised solar power risked the renewable subsidy for the entire installation. So operators simply avoided grid charging, even where it made technical and economic sense. A battery that could have absorbed cheap midday power sat idle instead.
Step back and it looks absurd. A battery is a tool for shifting energy through time. Dictating the origin of every single kilowatt hour strips it of exactly the flexibility it was built for. Delimitation option or lump-sum option
MiSpeL solves this by making mixed operation properly accountable. Operators get two routes to choose from:
The delimitation option allocates volumes through metering, in quarter-hour resolution. If you can prove exactly which kilowatt hour came from your own generation and which from the grid, every volume can be treated correctly. That is the precise route, but also the demanding one: it requires metering hardware and clean data processes.
The lump-sum option works with a simplified allocation. Less precision, considerably less effort. For smaller installations it is often the realistic choice.
This choice is not a formality. For co-location projects, meaning storage sited directly next to a solar or wind farm, it feeds straight into the business case. And it determines what metering infrastructure you need in the first place. Which leads to the next topic, because the precise route does not work without a modern metering system. Where things stand, and why it slipped
The Federal Network Agency was legally required to conclude the determination by 30 June 2026. That deadline was missed. The agency explains this by saying the consultation surfaced evidence of perverse incentives in certain configurations, as reported by pv magazine. The storage industry criticised the delay sharply, among them the German storage association BVES.
Since 5 August 2026, however, the working draft is on the table: the agency published three documents, the operative part of the determination plus one annex each for the delimitation and the lump-sum option. This is explicitly not a new consultation but early market information. Current planning has the determination taking effect on 1 October 2026, with transitional arrangements. One caveat remains: implementing the delimitation option is subject to state aid clearance by the European Commission, which has not yet been granted. Anyone planning now should build that into the timeline rather than assume everything is settled on 1 October.
What this means in practice
If you have a home battery with solar: the interesting question is whether you will be able to top up with cheap grid power without endangering the subsidy for your solar system. If you develop grid-scale storage: the transitional arrangements and the state aid caveat belong in every financing model. A timeline that assumes a clean start on 1 October is optimistic.
Why I follow this so closely
Because it makes visible what actually slows the energy transition down. It is rarely the batteries and rarely the technology. It is the question of how a kilowatt hour is treated in regulation when it could have two origins. Rules like this decide whether a storage project gets built or stays in the drawer.
And because I believe there is a wide gap between this regulation and what people and companies eventually buy. Anyone trying to find out today whether a battery pays off mostly finds vendor promises and very few defensible numbers.
